The Right to Retain Representation

As a taxpayer, you have the right to hire an authorized representative to deal with the IRS on your behalf. If you can’t afford an attorney or similar agent you may be eligible for free  assistance.

What this means:

  1. You may be eligible to receive assistance from the Low Income Taxpayer Clinic (LITC).
  2. You may be eligible to receive assistance through the Maryland Volunteer Lawyers (MVLS).
  3. Most often a representative can get you an extension of time on your audit or tax case.
  4. A representative can go in your place to attend IRS meeting with a Power of Attorney on file.
  5. The IRS can’t force you to attend meetings without a summons.
  6. Once you authorize your representative with a Power of Attorney, IRS is required to contact your POA on file.

*When we state representative in the above instances we are referring to a lawyer, enrolled agent, or certified public accountant. These individuals can attend meetings and represent you in front of the IRS state agencies, and other taxing entities.
